“मेरी wife ने complaint में मेरे पूरे family का नाम डाल दिया है… अब मैं क्या करूँ?”
यह सवाल Delhi में matrimonial dispute के दौरान बहुत भारी हो सकता है। Husband परेशान है, parents परेशान हैं, sister का अलग डर है और ऊपर से किसी ने कह दिया — “अब तो case हो गया, कुछ नहीं हो सकता।”
लेकिन court record हमेशा इतना simple नहीं होता।
10 March 2026 को Delhi High Court ने Sandeep Pathak & Ors. v. Lalita Tiwari में एक matrimonial dispute को काफी detail में देखा। Marriage 2005 में हुई थी, लेकिन parties बहुत कम समय साथ रहे। बाद में husband ने divorce petition file की और 5 September 2012 को ex-parte divorce decree मिल गई। इसके बाद wife ने Delhi में 498A/406/34 IPC की FIR और Domestic Violence Act proceedings शुरू कीं।
Court ने complaint के allegations को simply इसलिए accept नहीं किया कि वे serious सुनाई दे रहे थे।
Court ने देखा कि family members के खिलाफ कई allegations general और omnibus थे। कई जगह यह स्पष्ट नहीं था कि किस व्यक्ति ने कौन-सा specific act कब किया। Jewellery के मामले में भी entrustment के बारे में necessary particulars नहीं दिए गए थे। Court ने यह भी note किया कि parties ने matrimonial home में बहुत कम समय साथ बिताया था और बाद की घटनाओं की chronology महत्वपूर्ण थी।
और फिर वह बात आई जिसे हर husband को समझना चाहिए:
हर family member की role अलग होती है।

कोई message, bank record, medical document या दूसरा supporting material है?
बस “सबने मुझे परेशान किया” लिख देने से हर accused के खिलाफ एक जैसा factual case automatically नहीं बन जाता। इस particular case में Delhi High Court ने ultimately FIR भी quash की और DV Act proceedings भी quash कर दीं.
अब husband की दूसरी side भी समझिए।
अगर आप complaint against wife करना चाहते हैं, तो यही discipline आपके लिए भी जरूरी है। “उसने मेरी life खराब कर दी” शायद आपकी genuine feeling हो, लेकिन complaint में actual incident चाहिए — तारीख, घटना, व्यक्ति और available evidence.
यही वजह है कि CAW Cell Delhi का notice आने पर या wife की complaint पढ़ते समय तुरंत counter-complaint लिखना हमेशा पहला कदम नहीं होना चाहिए। पहले पढ़िए कि actually लिखा क्या है। फिर देखिए कि आपकी grievance क्या है और उसका documentary record क्या है।

सुने जाने के लिए सबसे पहले अपनी कहानी को साफ करना पड़ता है।
थोड़ा emotion side में रखिए, chronology सामने रखिए। क्योंकि court में “सब मेरे खिलाफ हैं” से ज्यादा useful होता है — “यह allegation है, यह date है और यह मेरा record है।”
